Reconstructing Intellectual Property Commercialization Policy As An Instrument For Strengthening the Competitiveness Of Indonesia's Creative Industry

Abstract

Background: Indonesia recognizes intellectual property (IP)-backed financing, but high registration activity has not consistently become licensing income, bankable collateral, or industrial scale.

Objective: This study formulates a reconstruction connecting legal protection, valuation, financing, licensing, enforcement, and market development to strengthen creative-industry competitiveness.

Methods: Qualitative doctrinal research was supported by secondary empirical data from legislation, administrative statistics, and institutional reports available up to July 2026 and analysed through a regulatory-chain matrix.

Results: Law No. 24 of 2019, Government Regulation No. 24 of 2022, the 2025 IP valuer regulation, the 2026 KUR guideline, and the 2026–2045 Creative Economy Master Plan form a progressive sequence, but gaps remain in ownership evidence, lender use of valuations, security perfection, default execution, royalty data, and regional access. Lender discretion and illiquid secondary markets constrain implementation.

Conclusion: A six-pillar architecture is proposed: integrated governance and data; transaction readiness; asset-specific valuation and risk sharing; clear perfection and execution; transparent licensing and royalty markets; and regional delivery measured by financing, revenue, exports, employment, and creator bargaining power.
