Reconstruction of the Peace System in Voting on the Postponement of Debt Payment Obligations as a Manifestation of Pancasila Cultural Values

Abstract

Background: The peace mechanism in Suspension of Debt Payment Obligations (Penundaan Kewajiban Pembayaran Utang or PKPU) emphasizes a majority voting system based on the number and value of creditors’ claims under Article 281 of Law No. 37 of 2004. This mechanism does not fully reflect the Pancasila principles of deliberation, balance of interests, and kinship.

Objective: To reconstruct the PKPU peace system to align it with Pancasila’s cultural values as the philosophical foundation of Indonesia’s legal system.

Methods: This study employs normative legal research using statutory, conceptual, philosophical, case, and comparative approaches. The analysis draws on theories of deliberative democracy (Habermas), balance of interests (Pound), and proportionality (Alexy).

Results: The peace system requires reconstruction by placing deliberation for consensus, dialogue, and substantive justice at the center of decision-making between debtors and creditors. This approach prevents exclusive reliance on the dominance of majority voting.

Conclusion: Reconstructing the PKPU voting system in accordance with Pancasila values would create a proportional, balanced, and just mechanism for debt settlement.
